Unvault Trademark Policy

1. What this Policy covers#

1.1 This Policy has two halves. Sections 2 to 4 explain how brand owners can report Collections, profiles, or content on Unvault that misuse their trademarks, and what Unvault does in response. Sections 5 to 7 explain how third parties may — and may not — use Unvault's own names and logos. It forms part of the Unvault Terms of Service, and capitalised words have the meanings given there.

1.2 A trademark is a name, logo, slogan, or other sign that identifies the source of goods or services. Trademark misuse on an NFT marketplace usually looks like one of these: a Collection that uses a brand's name or logo without permission to suggest it is official; a profile or Collection that impersonates a known project or person; a Drop that borrows a brand to sell unrelated items; or a domain, social handle, or Drop page designed to be confused with an established Collection.

1.3 Complaints about copied artwork are copyright matters and follow the Copyright Policy. Complaints that an item was stolen follow the Disputed Items Policy.

2. Reporting trademark misuse#

2.1 Where. Send reports to trademark@unvault.com or use the "Report" control on the Collection or profile page and choose "Trademark or impersonation".

2.2 What to include.

• (a) the trademark concerned, the goods or services it covers, and the country or countries where it is registered, with registration numbers, or the basis of your unregistered rights;
• (b) your name, organisation, and contact details, and, if you are acting for the owner, evidence of your authority;
• (c) the Unvault URLs of the Collections, items, Drops, or profiles you are reporting, with the network and contract address where applicable;
• (d) an explanation of why the use is likely to confuse people about source, sponsorship, or affiliation — for example, that the Collection claims or implies to be official;
• (e) confirmation that the user is not licensed or otherwise permitted to use the mark; and
• (f) a statement that the information is accurate and that you are the owner of the rights or authorised to act for the owner.

2.3 Impersonation of people. If someone is impersonating you or your organisation without using a registered mark, report it in the same way and describe the impersonation; we treat impersonation as a violation of the Terms of Service whether or not a trademark is involved.

3. How Unvault responds#

3.1 Review. We aim to review complete reports within two business days. Reports involving a live Drop or an active scam are prioritised.

3.2 Factors we weigh. We consider whether the reported use is likely to mislead users about who is behind a Collection or what it is connected to. Descriptive references — for example, a Collection description that truthfully says its items were inspired by a brand, or a fan community that clearly states it is unofficial — are not by themselves misuse. Use of a mark in a Collection name, logo, or Drop page in a way that suggests official status usually is.

3.3 Actions. Where we find misuse, we may remove the Collection, items, Drop page, or profile from display in the Services; remove or edit a misleading nickname; remove the Collection from search, discovery, and rankings; add a label; remove any badge; and restrict the responsible Wallet from launching Drops or Pools. Where the misuse is part of a scam, we act under the Disputed Items Policy as well.

3.4 Limits. Unvault acts only within the Services. We cannot change a smart contract's name or symbol, alter a Digital Item's metadata, take down a Creator's website or social accounts, or stop the items being traded elsewhere or directly on-chain.

3.5 Notice to the user and appeals. We tell the affected user what was reported and by whom, unless the law or a safety concern prevents it. The user may appeal to trust@unvault.com within 30 days with evidence of a licence, prior rights, or non-confusing use. A person who did not make the original decision reviews the appeal within 14 days. We may ask both sides for further information and may keep content down while a dispute is being litigated between them.

4. Repeat misuse and bad-faith reports#

4.1 Wallets or Creators responsible for repeated trademark misuse are handled under the repeat-violation rules in the Terms of Service and may be permanently excluded from the Services.

4.2 Reports that are knowingly false, or that are used to suppress lawful competition or commentary, are themselves a violation of the Terms of Service. We may decline to act on future reports from a person who has filed unfounded complaints.

5. Unvault's marks#

5.1 UNVAULT, the Unvault logo, BUGZ, GENESIS BUGZ, DIVIT, and our other names, logos, and product names are trademarks of Unvault LLC, licensed to Unvault (BVI) Ltd (together, the Unvault Marks), whether or not registered. Applications to register BUGZ (Serial No. 50053665) and GENESIS BUGZ (Serial No. 50053676) are on file with the United States Patent and Trademark Office. All rights are reserved. References in this Policy to "our" marks and to permission from "us" mean Unvault LLC as owner and Unvault (BVI) Ltd as licensee, acting together.

5.2 The Unvault Marks are separate from the Protocol Contracts, which are owned by UV Tech Foundation. A licence to use a Protocol Contract or its code does not include any right to use the Unvault Marks.

6. Permitted uses without asking#

You may, without a separate licence:

• (a) refer to Unvault by name in plain text to say, truthfully, that your Collection is available on Unvault, that your application uses the Unvault API, or that your item can be vaulted or traded through Unvault;
• (b) link to unvault.com and its subdomains;
• (c) use the phrase "available on Unvault" or "trade on Unvault" with a plain-text name or an unmodified Unvault logo obtained from us, provided the Unvault Mark is not larger or more prominent than your own brand; and
• (d) use the Unvault Marks in news reporting, reviews, academic work, and commentary.

7. Uses that require permission or are not allowed#

7.1 You may not, without our written permission:

• (a) use an Unvault Mark, or anything confusingly similar, in the name of a Collection, token, product, service, company, domain name, social handle, or application;
• (b) use an Unvault Mark in a way that suggests Unvault or the Foundation created, sponsors, endorses, audits, or is affiliated with your project;
• (c) alter, animate, recolour, combine, or abbreviate an Unvault logo, or place it inside another logo;
• (d) use an Unvault Mark on merchandise;
• (e) use an Unvault Mark in connection with anything unlawful, misleading, or in violation of the Terms of Service; or
• (f) register or use any trademark, domain, or handle containing an Unvault Mark.

7.2 Requests for permission, brand assets, and partnership badges go to trademark@unvault.com. Permission is granted case by case and may be withdrawn if the use becomes misleading or harmful. Where we grant permission, you must follow any usage guidelines we supply and stop the use if we ask.

7.3 If you become aware of anyone misusing the Unvault Marks — including phishing sites, fake support accounts, or fake Drops using the Unvault name — please tell us at trademark@unvault.com or security@unvault.com.
